Big Win For Malibu Mobile Home Owners! Anti-Rent Control Provisions From AB 317 Removed from Bill.

Buyers looking to purchase a mobile home in one of the two Malibu communities, should still review the Malibu Rent Stabilization Ordinance, which can be found in Chapter 5.16 of the Malibu Municipal Code. The California Civil Code that regulates mobile home communities and parks and should be reviewed as well.

Malibu mobile home owners successfully mobilized over the past several months to oppose AB 317, a bill that would have put limits on rent control at mobile home parks.

Assemblyman Charles Calderon, the author of the bill, learned from the state senators that their offices had received major opposition. Calderon took a pulse on the bill and realized the need to amend it. He removed many of the issues that the opposition presented in their lobbying/communication efforts.

Aaron Guttman, President of the Point Dume Mobile Home Park, said the changes were last minute.

“The bill had proposed to change the rules governing “second homes” including the rules that determine whether a home is the homeowner’s “principal residence,” Guttman said. “It would also have eliminated protections for homeowners who rent out their homes, or must leave them vacant because subletting is prohibited.”

Just prior to the committee meeting, Calderon edited his bill, leaving the “second home” rules untouched. Instead, the bill now alters an existing notice to prospective homeowners to include a statement advising prospective homeowners of the “principal residence” rule in existing law, according to Guttman.

“The bill in its new form is now a skeleton of its former language and primarily just rewrites in a new and revised format what the current law already states,” he said. “This culminates in a win for mobile home owners.”
